You've most likely seen the news by now. The recent bill to reopen the federal government included language that will ban more than 95% of all hemp products.

As a small business rooted in the hemp-derived space, we're disappointed, but we remain steadfast and optimistic. We have a full year before this ban takes effect, so we’re still open for business!

We understand you may have questions about what this ban means, so we’ve compiled some answers for you.

What Happened to Hemp?

Hemp-derived beverages and other hemp products became legal as a result of the 2018 Farm Bill, and our hemp-derived beverages have been fully compliant with this law. However, lawmakers did not include any specific regulations in this bill.

Recently, the House Appropriations Committee added a ban on hemp in the Continuing Resolution needed to reopen the government. While this new legislation technically allows up to 0.4 mg of THC in products, that minimal amount makes it nearly impossible for us to produce our products compliantly.

Why Did Lawmakers Ban Hemp?

Unfortunately, there are many bad actors in the hemp business making cheap, untested hemp products that are sold in packaging meant to mimic popular candy brands, which can be attractive to children. To address the youth concerns, lawmakers chose to “close the loophole” in the 2018 Farm Bill.

At Mighty Kind, we welcome regulation of our products and have actively advocated for regulation over a ban. We continually test our products with a third-party laboratory and post the results on our website, along with including QR codes that link to these documents on our cans. We also prominently include warnings and 21+ age restrictions on our intoxicating beverages.
